Review Topic: Adjustment of Status

The appointment was for 9 am, we got there at 8 am, but like usual when it comes to Government, "The first shall be last.” We were finally called at 9:35 am while other people who arrived after us went ahead of us, (they must have shelled out bucks for some fancy attorney) The adjudicator Reviewed our file, and then she asked both of us basic questions based on our application, verifying information, and so on. Then she ask for evidence of proof, if you do not know by now, MAKE COPIES! Such items as pay vouchers, leases, titles, mortgages, wills, powers of attorney, bank statements, letters, cards, and photos. She reveied the photos and approved us. The worse part is always the wait! Total time for interview less than 30 minutes

Be sure that you bring personal photos! They will not take your photos, just look at them. Therefore, I suggest you have them in album and explain the photos to the adjudicator while your spouse looks for copies of documents. They should be photos of you and your bride with family and friends. I would suggest just take your best photos, if you are like me and use a digital camera, I would suggest you save your best photos on a disc and get them printed at a local retailer.

You do not need allot of photos, since you just got into country, but just enough to show that from the time you got married to the present you and your spouse have lead a normal life. In our case, my wife has been here for almost 7 months and we had 126 photos out of the thousands taken. In any event just be yourself, if you have nothing to hide, you should have nothing to worry about all should go well provided you have your stories and your documents together. The entire interview took less than 30 minutes. If approved you should receive a conditional green card good for two years in about 10 days.

We showed up for the interview with a translator and when the lady called us in we all went to the door, my wife greeted her and we were asked for ID. She looked at our passports and then ask who was with us. I said we brought a translator as instructed by the appointment letter and understood that often times most English speakers were not able to understand the questions on the I-485 without a law degree. This got us a chuckle and she said, let's try this without a translator and if we need help she can come in to assist. So off we go to the office.

I guess I should mention that we had all been sitting outside chatting in English, showing our pictures to the lady who came to translate for us. We both decided to wear jeans and my wife was wearing one of her favorite T-Shirts that says "It doesn't get any better than this". :P

We sit down and she asks for the I-94 so I give her my wife's passport.
Then the questions begin, all directed to my wife speaking slow and clearly, she started going down the I-485 and verified name, address and her parents names.

Then she turned it over and starts down the dreaded lists of questions, she paraphrased the questions:

1. The are you a criminal question was asked an my wife paused and looked at me so I said jail, my wife immediately put her hands together like being handcuffed and looked at the lady and asked her "jail?". The IO laughed and said yes, to which my wife chucked and said No.

2. The drug question was asked and we went through be imitating shooting up and the IO was somewhat impressed to see we had discussed the questions.

3. The communist party question came up and neither of us could easily find a way to describe this, so my wife reaches in her purse and pulls our the pocket translator. While I was entering Communist the IO was asking about the pocket translator. I explained that this was our second because one of the buttons on the first one quit working. My wife looked at the translator and answered NO. I then turned the pocket translator around so the IO could see it and mentioned how many words had different meanings and this was a nice one that allowed us to choose context. The IO said she hadn't seen one of these before and I mentioned we didn't need to use it often for most things, but it was helpful to clarify things.

4. Then she ask about lying to the consulate and forged documents. I punched up forgery on the translator.

At that point she put up the I-485 with all of her red check marks beside the items she had verified. Turned to the Affidavit of support and I gave her my 2005 tax return. She asked what the company name on the employment letter did. She then did something on her computer and I asked if the name check was complete, she smiled and said that was what she was checking and said it was done.

She mentioned that she wished everyone's was finished before interview and said that she still had some cases that were from 2002 that were waiting on the name check. I mentioned that it was surprising and hoped they were filing a lawsuit to get the FBI to finish up. She smiled and said that was happening on a number of cases, I got the impression she may have suggested it to the people who have been waiting.

Then she said needed to see information that showed we lived together.

I handed her our stack of photos while I dug out the folder. She looked through our pictures and asked about the wedding, the horse my wife was sitting on at a friends, figured out we went to St Louis and loved the picture of my wife on the riding lawn mower at Lars house. :P

I passed over photocopies of the following:
Auto Registration, showing joint ownership
His and Hers Balley member cards
His and Hers Sams club cards
Insurance card
Dental Insurance pre-authorization form showing both names.
Sprint bill with both names
Revolving charge bill where we bought a new bed.
Joint Checking account statement - I offered her 3 months and she said she already had enough paper. :rolleyes:

She then put all of this in the folder and selected about 6 photos, I told her she could keep them and she said she would just make copies since the folders get rather thick.

While she was gone with the door open my wife and I chatted and she mentioned the amount of paper in her file, I told her it wasn't much and pointed to some 2-3 inch thick folders on the back desk which got a laugh.

The lady came back in and gave us back the pictures and said congratulations and handed us the paper saying we would get a welcome letter in the mail soon, and congratulations.

I asked if she could stamp my wife's passport and she said she couldn't until we received the welcome letter. I mentioned my wife would be leaving next week for China and that I was concerned about re-entry and asked if it was OK to keep the AP paperwork. She said that would be fine and that it should all be in the computer before she returned.

She never asked for EAD or AP in the process. Somewhere earlier in the process we mentioned that we were going back to China for our son's K-2 interview on June 29th and told her that originally it had been scheduled for next week.

The entire interview lasted 20 minutes and the IO was extremely nice during the entire process.

As usual, my wife informed me that "this was too easy". :lol:

EXCELLENT!!! EFFICIENT!!!! CURTEOUS!!!!FAST!!! I love that office. Everytime we had to go we were always met with kindness and professionalism. They know their stuff and all offices should be like KC in the SHOW ME...WHAT WHAT!!!!

I am amazed at this office, 5 stars for them!!!

My appt was at 9.30am, we got there at 9am. They didnt check for cellphones, cameras or food like the fresno office which even took my daughters snacks from her. Extremely friendly people! I put my form into a box, went to the bathroom, when I came back out it was already gone! I got called in at 9.20am! 10 mins before my appt time. My entire file was there INTACT nothing missing from being transferred from the Fresno Office. He asked for a few more forms, looked at a few pictures, photocopied some other stuff, asked a couple of basic questions.... took my fingerprints and signature for the card. Said he had to check how my background check went, and said that it was still being done... that the KC office was so ahead on their interviews etc that they were now waiting on all the background checks. So once that went thru, my card would be sent out .... he asked if I had any questions... I said thats it? He said yes, good luck and have a nice day!!!!!!!!!!!!! We walked back out of there at 9.35am! I cant believe how fortunate I"ve been, I only filed my AOS in March and I"m all done now!! YAYYYY....

Good Luck to anybody else having AOS appts, I hope they all go as smoothly as mine!

I wanted to share our experience. We were married on visa waiver and successfully adjusted today. (I know the topic is a ten foot pole item. This is not intended as encouragement for anyone to break the law.)

We went to the KC District office about 8:10, because our interview was at 8:30. Waiting in the lobby were an average amount of people, a few AOS couples and people getting fingerprints, but it wasnt crowded at all.

They called his name and we went back to her office. She swore us in and then we sat down. She went over our answers to all our forms, starting with the I-130 petition and then the I-485. She asked to see our certified marriage license and kept the copy I had made of it. (She didnt want to the originals of our birth certificates or papers as the letter had said to bring.) She asked me if it was my I-864 and I said yes. (I had also prepared another one because it said to have it on the interview appointment letter, but she didnt want it.) She asked for his Medical forms and opened them up, looked at them, and put them in the file.

She asked us how we met. She asked if he had intended to get married when he came over to visit the second time. (We met through friends at a club, and no we did not intend to get married. She didnt question this, although just in case I had all our wedding receipts showing planning began weeks after he got here, and items showing that he had intended to return.)

She then asked what evidence we had of a joint life together. I handed her a copy of our lease, renters insurance, medical cards in both names, beneficiary of 401K and insurance statement from employer, bank statements, bills from two different utilities in both names. She said that was more than enough and that I was really well prepared. (I actually had more evidence than what I gave her.)

Then she said she was printing a letter for us on the interview outcome. It said we're approved and should get a letter in about 30 days. They issue a I-551 card thing. They took his thumb print and made him sign on both the front and the back. She said that would arrive back to him with the letter. She said that card was good for travel to Canada and Mexico, but if he wants to travel internationally he should return for a stamp in his passport. She said the green card may take as long as 8 months to arrive.

She never asked to see photos. I said, you dont want to see pictures? She said I love pictures. I showed her about seven, our house, our pets, some things we've done. She had already approved us and was just being nice by looking at them.
